Scattering Ashes in California National Parks: Guide and Insights

Throughout this article, we use the terms "ashes,” “remains” and "cremated remains" interchangeably. While "cremated remains" is the more formal term, many families simply refer to them as "ashes." Read our guide to the differences in remains from various funeral options.

Not all national parks require permits for ash scattering, but most do - and California has some of the most detailed regulations governing the scattering of cremated, hydrolyzed, and reduced remains in the United States.

Permit approvals may take anywhere from a couple of weeks to 60 days to hear back on permits, so give you and your loved ones plenty of time to plan.

Ash Scattering permits are issued to help:

Protect sensitive ecosystems
Protect waterways
Prevent popular areas from becoming informal memorial sites
Preserve the visitor experience
Protect cultural and sacred sites

General Rules for Scattering Ashes in Parks:

Only human cremated remains may be scattered.
Remains must be scattered out of sight of roads, trails, parking areas, and other public-use areas.
Remains must be at least 100 yards from any watercourse or creek bed, whether dry or flowing.
Remains should be dispersed over a wide area so they do not accumulate in one location.
The cremation identification disc must not be left at the scattering site.
No memorial markers or commemorative items may be left behind.
Scattering from aircraft is prohibited unless specifically authorized.
Commercial remains scattering services are generally prohibited.
Parks cannot be closed or reserved for memorial ceremonies.

Scattering Ashes in California State Parks

Written permission from the District or Sector Superintendent is required before scattering remains in a California State Park. Requests are submitted through the park's Cultural Resource Supervisor. Commercial remains scattering services require separate authorization, and scattering is prohibited at archaeological sites, Native American burial sites, and other protected locations.

Upholding Natural Processes: Allowing Nature to Work as Intended

At its heart, terramation is about partnership with nature, and Return Home’s process is intentionally designed to support decomposition in a way that mirrors natural systems. While some terramation providers may rely on supplemental heat, or have overly engineered vessels that are prone to breaking down mid-cycle, Return Home’s approach is simple and incredibly gentle. Instead, the process is allowed to unfold naturally, with time, oxygen, gentle turning, and microbial activity doing the work of transformation.

“The microbes in our body break down the body when we die,” Jake explains. “If I were to die out in the woods, the microbes would transform my body over time. That’s what they’re designed to do.”

The terramation process unfolds in two phases. In the phase approximately 90% of decomposition occurs naturally, leaving only skeletal remains. In the second phase, the bones are reduced and then placed back in a second vessel along with the remaining material and continues transforming into compost.

Jake explains that while soft tissue naturally decomposes, bones can remain intact for centuries because microbes eventually lose access to their dense interior structure. Return Home gently reduces long bones into smaller fragments, allowing microbes access to the porous interior so decomposition can fully continue — completing the transformation naturally over time.

Reimagining Family Participation in Death Care

For generations, many families have been kept at a distance from death care processes- rather than active participants. But that is beginning to change.

"This specific industry has not really one that's evolved in quite a few decades,” explains Jake, “but I think that is beginning to change... I think that we are right at this changing point, more families are wanting to be more interactive, be that with terramation or something else."

Families may take part in every step of the process from bathing their loved one to laying-in ceremony, to ceremonially placing organic materials into their loved one’s vessel. In one deeply moving example, a mother asked to place the remaining organic fill into her son’s vessel herself, and later encouraged Return Home to share the experience so other families might feel empowered to participate too. Upon its original conception, Return Home did not anticipate families wanting to be active in the process, but these practices were adopted by Return Home out of continual requests of families.

Earlier this year, we worked with a family whose experience highlighted why these conversations are so important.

Mara* was a beloved transgender woman who died unexpectedly. Mara's mother belonged to a religious community that did not recognize transgender identities. After years of estrangement, Mara's inner circle worried that her mother could be identified as next of kin and gain authority over decisions that might not reflect Mara's identity, relationships, or wishes.

In this challenging case, Mara's mother could not be reached. While this reduced the likelihood that decisions would be made contrary to Mara's wishes, it also disrupted the normal decision-making process and created uncertainty during an already difficult time. As timelines advanced, Mara's community was left navigating legal and logistical challenges while trying to honor the person they loved.

The following sections explore common challenges LGBTQIA+ individuals may face during medical emergencies, funeral planning, and estate administration, and the steps that can help protect their wishes.

Medical Emergencies, Illness, and Hospitalization or Hospice Care

In the event of emergency or hospitalization, these are challenges that LGBTQIA+ face at higher rates than the general population:

Chosen family or community as a whole not being recognized
Unmarried partners being excluded from decision-making
Taking off life support
Approving and disapproving treatment
Estranged relatives, who are next of kin, becoming default decision-makers
Incorrect names, pronouns, or gender identities being used
Ceasing of gender-affirming care

What Can Help: Advance Health Care Directives

Advance Health Care Directives are legal documents that let you state your medical wishes in advance and designate someone to make healthcare decisions for you if you're unable to communicate them yourself.

An Advance Health Care Directive is a legal document that allows you to:

Name a healthcare agent to make medical decisions on your behalf if you cannot communicate your wishes
Document your preferences regarding treatment and end-of-life care

A healthcare agent can:

Speak with doctors and care teams
Access medical information
Consent to or refuse treatment
Make decisions based on your stated wishes and values
In California, the heathcare agent has “post-death authority” and can make decisions about organ donation, autopsy authorization, and the final disposition of your remains.

You can also document preferences with things such as:

CPR and resuscitation
Life support
Mechanical ventilation
Pain management
Organ donation

Without an Advance Health Care Directive, healthcare providers generally turn to next of kin as defined by state law. That person may not be the individual you would choose to speak on your behalf, or uphold your wishes.

Important Considerations for Advanced Healthcare Directives

Once your directive is completed:

Share copies with your healthcare agent
Upload a copy to MyChart or similar patient portals
Provide copies to trusted family members or chosen family
Consider sharing a copy with your chosen funeral home
Keep a digital copy on your phone or in an accessible cloud storage account for easy access in an emergency

Braeden Cohen, CEO and co-founder of LifeSource, recommends notarizing Advance Health Care Directives whenever possible. "Getting it notarized is the most protective way to complete an Advance Health Care Directive. You can even find 24-hour notary services. Simply letting people know what you want is not going to guarantee that you get what you want."

Chase, funeral director and cofounder at LifeSource, who has worked in funeral service for 14 years, says he encounters approximately one case a year where a lack of documentation creates complications for an LGBTQIA+ family

"People don't understand that once you get to the hospital setting, the rules completely and utterly change." Good intentions and verbal understandings do not carry weight once medical and legal systems become involved, so he recommends keeping a digital copy of your directive readily accessible so it can be provided quickly in an emergency.

Reflections on Death, Relationships, and Healing: How Pre-Planning a Funeral Can Bring Families Together

LGBTQAI+ Funeral Planning and Disposition Decisions

The person making healthcare decisions before death is not necessarily the same person who has legal authority over final disposition after death.

In most cases, documents that authorize someone to act on your behalf while you are alive, such as a Medical Power of Attorney or Advance Health Care Directive, expire upon death. In California, a health agent named on an Advanced Healthcare Directive has legal rights to make decisions on final disposition.

A prearranged funeral plan can help ensure your wishes are clearly documented and followed. Chase emphasizes the value of preplanning, "We (LifeSource) follow the pre-need to a T. The only time there are issues is when there are inaccuracies in the documentation."

As of 2026, human composting is legal and available to California families, even though the first in-state facilities are not expected to begin operating until 2027. Californians can access this nature-based option through partnerships with licensed providers in other states. Here is a look at the legal timeline, how the process works today, and what families can expect in the near future.

Human Composting Laws in California

2023: Human Composting Becomes Legal in California

Human composting was legalized in California through Assembly Bill 351 .The law recognized human composting, or natural organic reduction, as a legal form of final disposition. California became the fifth state to authorize this process, joining Washington, Colorado, Oregon, and Vermont.

2026: Human Composting is Available Through Out-of-State Partnerships

Although California-based facilities are still under development, residents can already choose human composting through licensed funeral homes such as LifeSource. We work with Return Home , located just outside of Tacoma, to make this option available to families throughout California.

2027: Cemetery and Funeral Bureau ready to accept applications for Human Composting Facilities

Beginning in 2027, the Cemetery and Funeral Bureau will start accepting applications for Natural Organic Reduction facilities. However, before any entity can submit an application they need to have already secured all other required permits, i.e. local conditional use permits, Air Quality Board permits, and Water Board permits, a process that can take up to 1 to 2 years.

2028 - 2029: Facilities may be Operating in California

Because the application and permitting process can take 1-2 years to complete, we may not see operating facilities until 2028 or 2029. Once operating, families have the option to complete the entire process closer to home, reducing transportation and expanding access to this sustainable option.

Once soil transformation is complete, families have several options for remains:

Receive all of the soil: Return all of your person’s soil back to California, via shipping.

Receive some of the soil: Return some of your person’s soil to California, via shipping, and donate the remaining to Return Home’s conservation projects in Washington state.

Donate all soil: Donate all of your person’s soil to Return Home’s conservation sites in Washington.

Current conventional burials may include embalming, expensive and elaborate lacquered hardwood or metal caskets, stone markers, and concretee, metal, or plastic burial vaults (aka outer burial containers.). All of these elements remain far beyond natural timelines. and prevent the body from reintegrating with the soil.

In contrast, natural burials:

occur in natural or conservation-focused cemetery, or section of a cemetery dedicated to natural burials

While there are certifying organizations like the Green Burial Council and the Conservation Burial Alliance , not all natural burial cemeteries are officially certified as such, but still may follow the same principles overall.

Involving children in the bereavement process helps them process loss as well.

How Pre-Planning a Funeral Mended a Relationship

"The topic of death has become a daily point of discussion in my life lately, mostly due to the unexpected passing of a friend and my part in assisting her family. However, it goes beyond the immediate circumstances and into my own life and relationships.

A few months ago, my father sat down with my siblings and me to discuss his after-death wishes and get our thoughts. I wasn’t sure what to expect exactly, except that I felt the love in being included in this conversation.

You see, for the vast majority of my 42 years on this earth, my dad and I had a very difficult relationship. About 6 years ago, I reached a point where I went completely no contact for the sake of my mental health. Through a series of synchronistic events 2 years ago, an opening was created that allowed us to tentatively reconnect. We were both in very different places in our lives, and our individual growth and ability to be fully honest with each other began a process of healing our relationship.

My sisters and I all have children, so most of our family gatherings involve children and partners, but this meeting with my dad was just my sisters, my brother, and me. There was something very special about being with just my immediate family and feeling the bond we all have.

What was most special was to hear my dad’s intentions with his plans, including to ease the burden on my siblings and me, and for his desire that we feel heard and included. This really demonstrated the love in how he wants to handle matters, and I felt more connected by hearing what was truly important to him. It led to moments of deeper understanding and healing for everyone present, including deeper healing in my own relationship with my dad.

Since that meeting, the passing of my friend has led me to have a more intimate knowledge of after-death care, and the immense burden it places on family and friends when a death is sudden, and no plans are in place. This really pulled death care matters into focus for me personally, and in the relationships in my life. My father and I have been regularly discussing death care, and even my 12-year-old and I have discussed some of the options because of their own curiosity.

My friend’s death is showing me just how loving an act it is to have plans in place for funeral plans, after-death care, and estate planning, regardless of the dollar amount in your bank account. I am a single parent, and while I had started getting documents and plans put together a while back, it has now become a much higher priority for me. I do not want my loved ones to have to guess at what I might want, to be burdened with figuring out my estate matters, to gather funds for a funeral, and plan it all while dealing with grief. I want to leave a legacy of love, and ease the burden on my family and loved ones, no matter when I may pass on.

Discussing death plans doesn’t have to be taboo or fraught with stress. Rather, I have found it can be a healing and bonding experience when it is approached with love and care for the people in your life."

There’s no question that conversations around sustainable funerals and death care are growing - and that they are important. Desmond Tutu chose water cremation for himself, and Martha Stweart wants a form of green burial or composting for herself. As with most things, sustainable deathcare exists on a spectrum. There is no “best” way to go as this decision largely depends on location, budgets, and preferences.

The environmental impacts of flame cremation are real . The benefits of alternatives like natural burial and natural organic reduction ( terramation ) are also real - and we greatly believe in the potential of regenerative options to positively reshape how we return to the earth. But accessibility is an important part of these conversations that often get left out.

The Economic Reality

Market research shows that a majority of Americans express interest in greener end-of-life options. Yet when families are faced with making a decision, cost remains the number one determining factor.

Even at LifeSource, where we work intentionally to offer natural burial and terramation at some of the most accessible price points in Southern California, these options are still financially out of reach for many families.

Are fossil fuel subsidies part of what makes flame cremation appear comparatively inexpensive? Absolutely. Should we be satisfied with that imbalance? No. But it is not fair to frame sustainable deathcare as a simple moral choice. Because for many families, it is a financial one.

The good news is that you are not limited to one path. Remains can be divided. Options can be combined. What matters most is that the choice reflects care — for the person who died, for your family, and for the land that will receive them.

In California, every option also carries legal and environmental considerations. Below is a guide to help you understand California cremation laws in regards to scattering ashes, what’s possible and how to move forward with clarity.

What Is “Reduction”?

Reduction is the process of returning the body to its basic elements more quickly than nature would on its own. Here we are talking about * terramation , aquamation , and cremation .

In the natural world, microbes, the elements, and time return the body back into the ecosystem, where nutrients are reabsorbed and life continues in new forms. Modern reduction methods are controlled under specific conditions, and what remains afterwards varies by each reduction option.

*In California terramation is also referred to as "reduction". Legally, a terramation facility is called a "reduction facility" and composted remains are called "reduced remains".

What Do We Mean by “Remains”?

The body is reduced through high heat. Remaining bone fragments are processed into what we commonly call “ashes” or “cremated remains.”

This weekly offering is a collaboration between Death Doula LA and LifeSource. Grief Yoga is a yin-style yoga class that targets areas of the body that store grief. This is a slow and subtle practice that provides a safe and supportive space for people to process their emotions and experiences. This practice aims for you to become aware of where you hold pain and struggle in your body and mind, and then use movement, breath, and sound to express and release those emotions. The Ash Rose Foundation
